ISHIBLOOM INTELLECTUAL PROPERTY GUIDELINES


For the purposes of this agreement, "Site" refers to the website of IshiBloom LLC (the "Company"), which can be accessed at www.ishibloom.com. "Service" refers to the Company's services accessed via the Site or any of the Company's various products, including but not limited to 51:22:51. The terms "we," "us," and "our" refer to the Company. "You" refers to you, as a user of our Site or our Service.

The Company has developed the following Intellectual Property Guidelines ("Guidelines") under which individuals and/or companies may publish screenshots, gameplay, music, sound effects and/or any other art or information related to the Company and/or its Service ("Art Media"). By publishing any Art Media you confirm acceptance of these Guidelines and agree to comply with them. These Guidelines apply to any and all material which you publish that incorporates, or is published in connection with, the Company's Art Media ("Publication").

If you do not agree to these Guidelines, you must not publish our Art Media without explicit written permission.


I. PUBLISHING RIGHT
i. No rights are granted under these Guidelines unless expressly stated.
ii. Subject to you complying with these Guidelines, you may create, upload, livestream and monetize videos of Art Media through online live streaming websites.
iii. Your monetization of Art Media may include advertising and partner programs of live streaming services and any other forms of monetization that comply with these Guidelines.
iv. You may only use Art Media which has been officially released to the public, or from promotional materials officially released such as product trailers.
v. You are not permitted to imply or state that you or your publications are officially affiliated with, sponsored, endorsed or approved by the Company unless given explicit written permission.
vi. Sound effects and/or music from our Service may not be published separately from its original form and/or appearance in its corresponding Art Media.
vii. These Guidelines apply to each part of any Publication as well as to its whole.


II. INTELLECTUAL PROPERTY
i. You acknowledge that we are the owner or licensee of all intellectual property rights in our Art Media.
ii. You may not sell any videos, sound effects, music or images that you have created using our Art Media.
iii. If you wish to combine the intellectual property of a third party together with our Art Media, you are responsible for obtaining any and all required permission from the third party or third parties.
iv. Where you upload or livestream Art Media, you give us irrevocable and perpetual permission to reproduce, upload, link to, and/or refer to the Art Media and any content incorporating Art Media you have published.


III. CONTENT STANDARDS
i. A Publication must be accurate (where it states facts).
ii. A Publication must be genuinely held (where it states opinions).
iii. A Publication must be lawful.
iii. A Publication must comply with all laws applicable in the country in which it is posted.
iii. A Publication must not breach any applicable local, national or international laws or regulations.
iv. A Publication must not be unlawful or fraudulent or have any unlawful or fraudulent purpose or effect.
v. A Publication must not be defamatory towards any person or persons.
vi. A Publication must not be obscene, offensive, hateful or inflammatory.
vii. A Publication must not bully, insult, intimidate or humiliate.
viii. A Publication must not promote sexually explicit material.
ix. A Publication must not include child sexual abuse material.
x. A Publication must not promote violence.
xi. A Publication must not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
xii. A Publication must not infringe on any copyright, database right and/or trademark of any other person, persons or business.
xiii. A Publication must not be likely to deceive any person or persons.
xiv. A Publication must not breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
xv. A Publication must not breach our End User License Agreement.
xvi. A Publication must not feature pirated software.
xvii. A Publication must not promote any illegal content or activity.
xviii. A Publication must not be in contempt of court.
xix. A Publication must not be threatening, abusive and/or invade another person's privacy, or cause annoyance, inconvenience or needless anxiety.
xx. A Publication must not be likely to harm, harass, upset, embarrass, alarm and/or annoy any other person or persons.
xxi. A Publication must not impersonate any person or misrepresent the identity or affiliation with any person or business, including but not limited to the Company.
xxii. A Publication must not advocate, promote and/or incite any party or parties to commit or assist in any unlawful or criminal act, including but not limited to copyright infringement and/or computer misuse.
xxiii. A Publication must not contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
xxiv. We will determine, at our sole discretion, whether a Publication breaches these Guidelines.


IV. BREACH OF THESE GUIDELINES
i. We have the right to require you to remove, take down and/or delete any Publication for any reason. Reasons we may do this include, but are not limited to, our believe that the Publication, or any part of it, is unlawful, infringing, inappropriate or otherwise noncompliant with these Guidelines.

ii. Failure to comply with these Guidelines constitutes a material breach of the terms of use upon which you are permitted to publish Art Media, and may result in our taking any or all of the following actions: immediate, temporary or permanent withdrawal of your right to publish Art Media; require that you immediately, temporarily or permanently remove any Publication; issue of a warning to you; initiate legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; initiate further legal action against you; disclosure of relevant information to the appropriate law enforcement authorities as we reasonably feel is necessary or as required by law.

iii. We exclude our liability for all action we may take in response to breaches of these Guidelines. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

V. LAW AND JURISDICTION
i. If you are a consumer, please note that the terms of these Guidelines, their subject matter and their formation are governed by American law. You and we both agree that the courts of the United States of America will have exclusive jurisdiction over legal matters that may arise from a breach of these Guidelines, or from any other matter concerning Art Media or use of the Company's Service.

ii. If you are not a consumer, the terms of these Guidelines, their subject matter and their formation (and any non-contractual disputes or claims) are governed by American law. We both agree to the exclusive jurisdiction of the courts of the United States of America.

VI. CHANGES TO OUR INTELLECTUAL PROPERTY GUIDELINES
The Company reserves the right to change these Guidelines and our Terms of Service at any time. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this Guidelines page for updates.
